Meeting 1/22/13

The Sex Offender Civil Commitment Task Force Meeting Installment #6 I believe jumped off last Tuesday Night down at the usual meeting location, Room 5, State Office Bldg. St. Paul, MN.

I picked up my Dad at White Castle in Hopkins/SLP and I drove us to preordained meet locale with MSOP HosPrisoner Tim Lincoln Mom, where we pick her up and ran down to the meeting. I thought my attorney was going to be attending, so when I saw a tall guy, well dressed with a fedora looking lid, I thought it was Peter J. Nickitas, Esq. and as I started to roll the window down, I recognized it was the Chair, Eric Magnuson and I proceeded to find a meter. I was glad that the meters were off.

Once the meeting commenced, there was an update as to what is happening in the legislature at present in regards to the MSOP. Sen. Tony Lourey (of Kerrick, who is LEADING in getting things handled this Session once and for all re the MSOP) indicated that is general recognition that the MSOP is once again front and center in due time, especially this year under the current circumstances, but that at the moment it is on the radar screen but not in any immediate context. Senator Lourey indicated that the legislators are aware of the Karsjens litigation, and of the existence of this Task Force, as well as what the charges within Karsjens entail.

Representative Tina Liebling of Rochester, who works very closely with Olmsted CountyAttorney Mark Ostrem for the benefit of our State, reiterated Senator Loureys briefing and emphasized that education and prevention are the correct directions to go. Donna Dunna of the Center for Sexual Violence very strongly echoed the theme that has been consistent in every meeting in my memory from Rep. Liebling: Early Intervention Strategies, Prevention, Victim Services, Excellent (Not adequate) Mental Health Beds/Infrastructure and Resources.

Rep. Liebling has consistently LED, ALONG WITH Donna Dunn in the areas of progressing thinking regarding where is the place to harness massive finacial and human resouces and assets: On the front end, where you may prevent anyone from being harmed/victimized, or certainly fewer than our failed, immoral practice of ",,,get 'em on the back end" (as I believe it  was Judge Joanne Smith, who showed her unquestioned character, integrity and commitment (pardon pun) to the State and Federal Constitutions and to the Rule of Law) which is unconstitutional, requiring constant expensive litigation, which we as a State absolutely cannot afford 70+ M/Yr on Sex Offenders.

The meeting moved into a lenghthy, substantial discussion of several issues relating to the remaining charges in the Karsjens Order. There was a significat emphasis on what can be done to slow the number of commitments coming into MSOP. THERE WAS NO DISCUSSION OF AN INJUNCTION/MORATORIUM IN LIGHT OF THE INFORMATION THE STATE HAS HAD SINCE THE AUDITORS REPORT THAT THERE ARE SERIOUS PROCEDURAL AND SUBSTANTIVE DUE PROCESS CONSTITUTIONAL BEDROCK CONCERNS ABOUT MSOP.

THERE IS NOW IRREFUTABLE EVIDENCE THAT THE STATE CONCEDES THAT NUMEROUS FACTORS, INCLUDING WHAT COUNTY YOU LIVE IN AND WHAT YOUR RELATIONSHIP IS WITH YOUR LOCAL BOYS IN BLUE, PROSECUTOR, JUDGE ETC. EXACTLY WHAT I AM SHOUTING FROM THE ROOFTOP: YOUR SYSTEM IS BROKEN AND DYSFUNCTIONAL. IT DOESN'T WORK RIGHT. YOU MUST STOP FOR NOW! THE STATE OF MINNESOTA IS OBLIGATED CONSTITUTIONALLY, LEGALLY AND MORALLY  TO GET AN INJUNCTION/MORATORIUM IN PLACE IMMEDIATELY.

PLEASE DO THIS IN THE NAME OF JUSTICE & TO LIMIT STATE LIABILITY RE: $.

I requested in my Public Comments that the Task Force URGE Governor Dayton to Repeal Ex-Minnesota Governor Tim Pawlenty's Executive Orders, which are/were unconstitutional and should never have been followed by anyone. Unconstitutional laws do not require enforcement. 23 EO Now.

I informed the Task Force Members of behalf of MSOPolitcal Prisoner Chris Krych, who has been repeated ly assulted in his forced illegal, unconstitutional double bunging of two dangerous sex criminals, which has resulted in an unholy epidemic of rapes, sexually transmitted diseases (including 14 Confirmed cases of HIV/AIDS) and other sickening issues that even I feel a little bit sorry for the State as I know that when the dust clears in the wake of the imminent closing of  MSOP, the lawsuit damage/compensation totals will be in the billions, and we will pay for more everyday until closed.

THE TASK FORCE IS MOVING FORWARD SLOWLY AND DELIBERATELY. RESOURCES ARE BEING COLLECTED AND SIFTED THROUGH AND THE BEST IDEAS GOING FOR THE REVIEW FOR DISCUSSION. THEIR WAS A LOT OF TALK ABOUT THE PANEL ENVISIONED FOR A CENTRAL TEAM OF EVALUATORS WHO WOULD ESSENTIALLY SUPERVISE THE DECISIONS OF WILLIAM DONNAY'S UNIT IN THE DOC, AND ALL OTHER REFERALS.

THERE WAS AN UNINTRODUCED BILL LAST SESSION THAT HAS SUCH A pANEL CREATED I BELIEVE OF MN STAKEHOLDERS. I LOOKED AT THE TITLES AND PEOPLE WHO FILL THEM AND WOULD TELL YOU THIS WILL NOT WORK, WON'T SOLVE ANYTHING. I TOLD THE TASK FORCE TWO MONTHS OR MORE WHAT THE ANSWER IS:

YOU MUST HAVE OUTSTATE EVALUATORS AND OUTSTATE NON-EVALUATORS ON THE PANE. I CANNOT EMPHASIZE THIS ENOUGH. YOU MUST REMOVE POLITICS AND PRESSURES AS MUCH AS HUMANLY POSSIBLE! EVEN SO JUST BAD IDEA. EXPENSIVE!

IF YOU HAVE ANYONE FROM MN ON THE PANEL THE PANEL IS SHOT.

I WAS VERY PASSIONATE ABOUT THIS AFTER THE MEETING SO AS I WAS TALKING TO SEN. LIMMER I WAS IMPLORING HIM NOT TO USE PEOPLE LIKE MARK OSTREM AND JOHN KIRWIN  AS THEY HAVE VESTED INTERESTS IN THE OUTCOME.
