I have ISOLATED one QUESTION that NEEDS to be ANSWERED by State Officials:


 

 WHY are the privacy rights of State Labeled "Worst of the worst" Sexual Criminals TRUMPING OUR RIGHTS AS LAW ABIDING CITIZENS TO LIFE, LIBERTY AND THE PURSUIT OF HAPPINESS VIA LAW PROHIBITING US ACCESS TO THE VERY CASES INVOLVING THESE CRIMINALS, AND THE RISK ASSESSMENTS THAT ARE DETERMINATIVE AS TO WHETHER YOUR WIFE, FIANCE', DAUGHTER OR GRANDDAUGHTER IS MURDERED IN OUR STATE

WHY WON'T THE STATE RELEASE IT'S WORK PRODUCT FOR INVESTIGATION?

WHAT ARE THEY HIDING FROM US? AND WHY?

Are State Officials so very sensitive to the rights of criminals in this context (yet they flagrantly violate their rights in every are they can figure out) or is it something more dark and sinister?

I AM RESPECTFULLY REQUESTING THAT THE LEGISLATURE AMEND STATE LAW SO THAT THE CLASSIFICATION OF THIS TYPE OF DATA ON DANGEROUS, RECIDIVIST CONVICTED SEX CRIMINALS IS PUBLIC, REGARDLESS OF THE CRIMINALS RIGHTS.

    I'm interested in obtaining Steven Roger Johnson's Risk Assessments, particularly his most recent and any evaluations with respect to potential referral for SDP/SPP Civil Commitment.
     
    If Mr. Johnson was reviewed and passed on referral for commitment please send me that Risk Assessment and/or please name all evaluators. 
     
    More generally please advise as to processes and estimated cost for all RA/CN Unit Risk Assessments either since 1975 or since Bill Donnay's employment within DOC.
     
    Finally can you please let me know what is public data with regard to Mr Donnay's background, education, qualifications prior to and throughout his storied career--including his CV if he has one. 
     
    I am not seeking any non-Public Data at present regarding Mr. Donnay.

    A wily strategic move by Mr. Donnay. Kudos. I guess if I share with the PUBLIC his response (via the Original email)on that one I might just as well put my hands behind my back (again) I guess. Wow.
    No such Legal Disclaimer in earlier emails, but as the game is narrowed, there it is. Good thing I had consumed a cup of coffee and not missed the disclaimer...wow, what a relief! That was a close call
    What Mr. Donnay says in this suddenly "Legally Privileged" email response is the following:
    Then I received an email this morning from Randy Hartnett from DOC Legal, and it also had the dreaded Legal Disclaimer. Here are the bullets:
    • We've received your requests for data related to Risk Assessment and Civil Commitment Data related to Offender Steven R. Johnson, as well as information as to how to obtain all Risk Assessments since 1975
    • Due to Minn. Stat § 13.851, subd. 6, data related to End-of-Confinement Review (ECRC) risk assessment are governed by Minn. Stat. § 244.052. That provision requires that dissemination of ECRC is to be made only by local law enforcement based on criteria set out in the provision, and which are related to the Risk Level determined. The one exception to this is the requirement that the Department of Corrections make certain data related to Level III offenders available on-line, as set out in Minn. Stat. § 244.052, subd. 4b. This data is available at the department’s public website.
      As for any data related to civil commitment under Minn. Stat. § 235B.185, it is classified as private medical/psychological data under Minn. Stat. §13.85, subd. 2. As with any private data of which you are not the data subject, it may only be obtained based on a release of information authorization signed by the data subject or by court order.

    • I'm not sure what to do in response to this other than try to obtain Johnson's Information Release.
      I expected they had a mechanism to keep me, the media and/or any other invetigators seeking this data from being able to occur short of obtaining releases from every one of their subjects.
      There is something very wrong with this Process.
      This Process allows Donnay and the DOC to feed society the most dangerous people they have assessed, with reasonable degree of confidence that these very dangerous and deadly tiny subset of offenders will strike as the State expects, and then Policy can be formulated and/or adjusted to assist the State with its real and true agenda, which is a Criminal War on Sex Offenders https://dl.dropbox.com/u/24465959/The%20Emerging%20Criminal%20War%20on%20Sex%20Offenders.pdf and then there is NO WAY to prove this theory.
      Additionally, Donnay's public information is extremely limited, as he refusues to provide any information about his early life, and any info other than his COLLEGE Education and his Employment solely within the DOC since like 1980 or so.
      Donnay states in writing that there is no requirement that the DOC psychologists (who are making all of these life/death decisions) in his RA/CN Unit undergo ANY Psychological Testing themselves (inc. Donnay) to attempt to rule out any people making these decisions who are mentally unsound for any reasons.
    Here is an excerpt from my blog post dated Friday, January 4, 2013, which I find to be eerily prescient: I asked Commissioner Roy about my idea relating to converting MCF-Lino Lakes into a Centralized MSOP location, and he indicated he bounced it around the brass, and the thinking at present is the DOC wants to see what becomes of these meetings, and is reticent to make such a massive change presently. I expressed some of my concerns relating to the RA/CN Unit, and especially William Donnay,who has been in power in the DOC since probably the 1970's and has signed off on the releases of numerous men who were not referred by his Unit for civil commitment, and went on to commit the Unholy Grail of sex crimes--Sexually motivated homicides/murders. It is inconceivable to me that Bill Donnay simply erred again and again in signing off on the releases on several dangerous, violent, mentally ill, recidivist sex offenders who all then graduated to sexual murders. How can Donnay be referring hundreds for commitment during the time he's releasing a half dozen of the obviously most dangerous and deadly. I'm publicly calling for an investigation into this Unit of Donnay's and of William Donnay himself. WHY would he keep making these "mistakes", and why was he never held accountable or sued by any families of murder victims. Is the Statute-of -Limitations only 6 years for criminal negligence? How many more mistakes by Donnay does the public have to accept, and family members of preventable murder victims have to accept and how many more murderers is William Donnay going to free before he retires? Just how many more? Commissioner Roy stated to me his belief that his Risk Assessors, the same people responsible for releasing Alfonso Rodriquez, Donald Blom & Co. and then refers me and many hundreds of low and moderate risk sex offenders for civil commitment are world class, and are the best in the business. I respect Commissioner Tom Roy immensely (both personally and professionally) but I do not believe that his assessment is accurate. The Minnesota Department of Corrections is blessed and lucky to have Tom Roy at the helm, as are the prisoners under his responsibility. I had to learn fast in prison how to correctly size someone up in sometimes seconds, and other times longer periods of time in order to literally survive in prison as a falsely labeled "sex offender". In talking with Commissioner Roy, I was struck by his courtesy, respect, and wise words shared with me. He told me he respected my right to voice my opinions, whether they are popular or not, and that due to my experiences it would be natural to become obsessed with all of this MSOP stuff, etc., but that establishing balance in one's life is important. This kind of compassion, empathy and sympathy for someone badly abused by the "system" is very rare. Thank you, Mr. Roy. I will say that if Commissioner Tom Roy is right and I'm the one who's wrong (it has been known to happen!) that if the best people we have are making the predictions we can show they have made, then there should be no clearer evidence necessary that our current system of risk prediction is too fraught with error, and that it is impossible to predict with ENOUGH accuracy or certainty to even make these commitments constitutional! Please recommend the Injunction/Moratorium like Illinois Governor George Ryan did when evidence surfaced that the Capital System in IL was broken.

    The title of this post is the title of this new article on SSRN from Corey Rayburn Yung (who also runs the terrific blog Sex Crimes). Here is the abstract for Corey's new piece:
    This article addresses four central questions. First, what is the difference between normal law enforcement policy and a “war” on crime? Second, assuming such a line can be discerned, has the enactment of the Adam Walsh Child Protection and Safety Act (“AWA”) in combination with other sex offender laws triggered a transition to a criminal war on sex offenders? Third, if such a criminal war is emerging, what will be the likely effects of such a transition? Fourth, if such a criminal war is emerging with substantial negative consequences, can it be stopped? By reviewing America’s history of criminal wars, primarily in the War on Drugs, the article identifies three essential characteristics of a criminal war: marshaling of resources, myth creation, and exception making. It concludes that the federalization of sex offender policy brought about by the AWA elevated law enforcement to a nascent criminal war on sex crimes.     MINNEAPOLIS (AP) — A Minnesota man was charged Wednesday with shooting his wife after an argument, sawing her body into pieces and hiding her remains in plastic bins in a friend’s garage.
    Steven Roger Johnson, 34, of St. Paul, was charged with second-degree murder in the death of his wife, Manya Jewel Johnson, 32. According to the criminal complaint, Johnson admitted that he killed his wife on Sunday after she told him she was leaving and taking the couple’s 18-month-old son with her.
    Johnson allegedly told police he had been drinking when he shot his wife in the head and “used a saw to dismember her body in the shower and he placed her in several plastic bins,” the complaint said. Johnson said he then cleaned up his home to hide any evidence and took the bins to his friend’s garage in the St. Paul suburb of White Bear Lake.
    The friend didn’t know what had happened until Johnson told him later, and the friend called authorities.
    Johnson was in custody Wednesday and unavailable for comment. It was unclear if he had an attorney.
    According to the charges, St. Paul police went to the Johnson home Monday to check on Manya Johnson. When officers arrived, they were told that White Bear Lake police had received a call from Johnson’s friend, who reported that Johnson told him Manya Johnson was dead and her body was in the garage.
    While St. Paul police were at Johnson’s home, he showed up with a woman who worked with Manya Johnson, and they told police they were looking for Manya. Johnson told police he had left his job to look for his wife after getting a text message saying she hadn’t shown up for work.
    Manya’s co-worker and Johnson told police they found her car at a park-and-ride lot.
    As an officer was talking with Johnson, the Minnesota Bureau of Criminal Apprehension called the officer and said authorities had found the dismembered body.
    Johnson was then arrested, the complaint said.
    “This horrific crime is an unfortunate example of how quickly domestic violence can turn into homicide,” Ramsey County Attorney John Choi said in a statement.
    Johnson was convicted of first-degree criminal sexual conduct in 1996, after he and an accomplice allegedly handcuffed a woman in a car and raped her. Authorities alleged Johnson threatened to kill the woman and claimed he had a gun.

    Look what I found that the mainstream media is asleep on thus far: Appellant Steven Johnson pleaded guilty in 1996 to charges of aiding and abetting first-degree criminal sexual conduct in violation of Minn. Stat. §§ 609.342, subd. 1(c), .05 (1996). The district court sentenced him to 206 months in prison, a double durational departure from the presumptive guidelines sentence. The district court found a number of aggravating factors in the commission of the offense including: multiple acts of penetration, acts of penetration in the presence of another, physical restraint of the victim resulting in physical injury, references to a weapon, significant advance planning, invasion of the victim’s zone of privacy, particular cruelty by forcing the victim to be nude in 50-degree temperatures, and the length of the assault.
    No less than 8 (Eight) Aggravating Factors! Enough!
    I had this information early yesterday after I searched the State Law Library for Johnson's appeal, but I decided to wait to blog until I was able to fully process my sadness that Bill Donnay released Johnson, only to have this crime occur, which was extremely predictable based on his 1996 offense. In fact, from a clinical forensic standpoint, Johnson's 1996 horrific behavioral pathologies represented essentially a Blueprint For Murder.

    I am in the process of obtaining Mr. Johnson's Risk Assessments conducted by Mr. William (Bill) Donnay's Unit and I urge the media to obtain the same information, including any assessments relating to civil commitment for Mr. Johnson. I am also respectfully requesting the media obtain information as to who the gun is registered to and how Johnson obtained it seeing as he was prohibited from owning or even being in temporary possession of a firearm--A felony level offense.

    After nearly a dozen years in prison for raping a woman he didn't know when he was 18, Steven Roger Johnson seemed to be building a new life. He married Manya Johnson. They bought a home in St. Paul's comfortable Como neighborhood and had a toddler son. But on Monday, Jan. 7, Steven Johnson reportedly called a man named Nathan Schram, telling him Manya Johnson had slipped in the shower and died, according to one of Schram's neighbors. "(Johnson) told him he cut her up, put her in bags and left her in the garage" of Schram's White Bear Lake home, said the neighbor, who declined to be identified.     neighbor said he was told. Steven Johnson and Schram served time that overlapped in the same state prisons, Schram for helping cover up a murder his mother committed. Police stressed that Schram is cooperating with police in the Manya Johnson case, and at this time in the investigation, there's no indication he's involved in the death of Manya Johnson, which they are calling a homicide. Authorities haven't detailed what happened to Manya Johnson, 32, who worked for Target Corp., but they have arrested Steven Johnson, 34, on suspicion of homicide. The Johnsons' 17-month-old son was in the family's St. Paul home in the 1400 block of Sheldon Street when his mother was killed, said Sgt. Paul Paulos, St. Paul police spokesman. The boy
    was uninjured and is being cared for by someone else, Paulos said. A missing person's report was filed at the Johnsons' home Monday. Then, about 3 p.m. Monday, Schram called police and reported the body of a homicide victim might be in his garage. Police discovered Manya Johnson's body in the White Bear Lake garage and found Steven Johnson at the couple's St. Paul home. Schram was at work when Steven Johnson called, and Schram contacted police at once from his workplace to tell them about

    a body that might be in his garage, Schram's neighbor said. "They didn't find it when they first looked," the neighbor said. They eventually found the body tucked under a blanket, the neighbor said. It wasn't immediately known how Manya and Steven Johnson met or how long they'd been together, though they were married Sept. 20, 2009, according to marriage records. Manya Johnson graduated with a bachelor's degree in psychology from Pacific Lutheran University in Tacoma, Wash., in 2002 and earned a master's degree in counseling psychology from Bethel University in 2009, according to her LinkedIn profile. She was a manager in marketing operations at Target Corp. at the time of her death, the profile said. She had done work for Target since 2003 and had been a communications consultant for the Mayo Clinic a year before that. "Our thoughts and deep sympathies go out to the family, friends and colleagues of Manya Johnson who had been a Target team member since 2003," Target spokeswoman Molly Snyder said. "We are providing our team with resources and support during this difficult time." 1996 RAPE CONVICTION Steven Johnson had been convicted of aiding and abetting first-degree criminal-sexual conduct in 1996, when he was 18. In 1996, Johnson and two men followed a woman, then 28, as she pulled into a Coon Rapids driveway. Johnson persuaded the woman to step back to his car to look at something, and he and another man forced her into the car, the woman said in an interview Tuesday. They drove her to Sand Creek Park, where Johnson showed her something he said was as a badge and then handcuffed her. Johnson and another man raped the woman repeatedly, with Johnson saying he had a gun and threatening to kill her if she didn't cooperate, the criminal complaint said. Johnson drew twice the sentence recommended in guidelines based on aggravating factors, according to a Minnesota Court of Appeals opinion that upheld Johnson's sentence. The factors included restraint of the victim that resulted in injury, references to a weapon, "significant advance planning," "particular cruelty by forcing the victim to be nude in 50-degree temperatures, and the length of the assault," the opinion said. The victim
    said Monday she was shocked to see news of Johnson's arrest in the homicide but added, "I'm not surprised that this kind of behavior would come up again." She knew Johnson was out of prison, though not that he had started a family. Hearing about the couple's toddler made her feel sick, she said: "He's going to be without parents. There's an innocent victim there." As for what happened to her in 1996, the woman said Johnson "was the mastermind of the whole thing, the whole rape. ... He was the one who scared me the most." She said she learned in the court process that Johnson had a juvenile record. The woman recalled that in her victim-impact statement in court she told the men involved, "You guys will get out of prison, but I'm sentenced for life. This will never go away for me." Johnson was released from prison Feb. 25, 2008, and is on supervised release until 2018. He and Schram were both in the St. Cloud prison in 1996 and 1997, and the Lino Lakes prison from 2004 to 2008, according to state Department of Corrections records. A neighbor said Schram's small tan bungalow in the 2200 block of Eighth Street of White Bear was cordoned off by law enforcement for about six hours Monday, their efforts focused on the property's two-stall detached garage. Schram, also known as Nathan Lattu, is on supervised release for aiding and abetting a 1995 Minneapolis murder. Schram's mother shot her husband to death while he slept, and Schram and his mom planted a phony revenge note and ransacked the house to make it look as though the man had been killed by an intruder. Schram couldn't be reached for comment Tuesday. AT HOME IN ST. PAUL The Johnsons bought their home, a block from Como Park, in April 2010, according to property records. Steven Johnson was a registered sex offender and neighbors were concerned at first, said Cherste Eidman, who lives in the area. "My husband and I, we put a card in their (the Johnsons') mailbox that said, 'We know about your past, but we believe in second chances and it sounds like you've done your time. We welcome you to the neighborhood,' " Eidman said. "That night, Manya and Steve showed up at our doorstep, holding the card and almost in tears. They said, 'Thank you, thank you for reaching out to us.' " They talked for about an hour and a half that night, Eidman remembered. "He looked like a choirboy," she said. "He didn't look his age, he looked like a kid." Steven Johnson offered no details about his crime but said that he regretted it, that he had turned his life around and that he and his wife wanted to start a family, Eidman said. Eidman said she and her husband encouraged the Johnsons to write a letter to neighbors, saying they wanted to be part of the community and they hoped people would accept them. They did, and most neighbors seemed to accept them after that, she said. "Manya was a beautiful person, and if she accepted him, why couldn't we?" Eidman said. After the Johnsons had their son in August 2011, neighbors fell in love with the little boy and "forgave or got past Steve's past," Eidman said. Eidman last saw the Johnson family before the snow fell. "Steve had his son on his shoulders, he and Manya were holding hands, and they were smiling and happy," she said. "I never, ever would have guessed there was anything wrong or it would have ever come to this." CHARGES PENDING Steven Johnson remains in the Ramsey County Jail. Prosecutors are reviewing the case for charges, which could be filed Wednesday. Eidman and her husband saw police cars in the alley behind the Johnson home Monday night. Eidman's husband figured the Johnson's garage had been broken into, not believing anything more sinister, Eidman said. Eidman first heard Tuesday afternoon that Manya Johnson was missing and then learned that she'd been killed. She said she and other neighbors are shaken by the homicide and the circumstances around it. "I couldn't believe it," Eidman said.
