Rec. 6: Immunity for Admissions Made in Treatment

Recommendation 6:

Provide 5th Amendment protection (Immunity) from civil or criminal prosecutions of any admissions of criminal conduct during sex offender treatment/therapy. Approximately 80% of the convicted sex offenders in the MN DOC are being released without completing treatment, and the primary reason they refuse treatment is fear of being civilly committed based on such admissions.

If treatment and successful, safe reintegration into society are legitimate State goals for sex offenders, then changing the law to allow men to fully participate in therapy without fear of their treatment admissions being used later against them is very important for this goal being realized.
